GENERAL TERMS OF USE OF THE INTERNET SITE www . bicycle . bg

The use of this site and the registration of an order through it is considered to be an agreement with the stated conditions. If you DO NOT ACCEPT these terms, please do not use this website www . bicycle . en . This website reserves the right to change the terms at any time, without prior notice, and the changed terms will be posted on the site.

*   Purchase of product/s on credit 

1. Any user who wishes to purchase a product/s on credit through the online store should apply to a financial institution for a loan. Only a user whose specific online order has a total online price (excluding the delivery price) equal to or greater than BGN 250 (two hundred and fifty) has the right to apply for a loan, regardless of the number and the unit online selling price of the goods included in the order.

2. The application is made: only online, only through the website by clicking on the "buy on credit" button, after which the prescribed procedure is followed. The conditions that the user must meet in order to be granted a loan are determined unilaterally by the financial institution, in accordance with its credit policy. Bicycle Ltd. is not involved in any way in the crediting of the purchase, as well as in any of the relationships related to crediting, including but not limited to the determination of the conditions for applying for credit, the approval or refusal of crediting, the determination of the terms and duration of the loan agreement, in case of default - in taking the actions provided for in the law related to forced execution, etc. Bicycle Ltd. is not a representative and does not carry out intermediary activities for the benefit of any commercial bank. The delivery of goods/s purchased on payment through the online store is carried out only after Bicycle Ltd. has been notified by the financial institution that the applicant has been approved, with the subject of crediting the full amount of the respective order.

3. The standard term for delivery to a populated place on the territory of Bulgaria is 3 working days     and begins to run from the moment when Bicycle OOD receives the notification according to the previous sentence and contacts the applicant. Upon receipt of the requested product/s, the customer signs the Consumer Credit Agreement, the Request for Consumer Credit Declaration and the insurance certificates, in case he has chosen secured credit. The borrower prepares a copy of his identity card in advance, on which he writes "True with the original" in his own hand and signs. The copy of the identity card is given to the courier. Delivery is carried out on the basis of the data (name, surname and social security number, delivery address - work or current address) specified by the customer in the Consumer Credit Agreement. The receipt of the product/s is carried out personally by the person who concluded the credit agreement, after confirming his identity by presenting an identity document.

I. General conditions 

• “ www . bicycle . bg " is an e-commerce website - for the sale and delivery of the goods published on it, on behalf of Bicycle Ltd. 
• The publication of this site has the meaning of a public invitation for the conclusion of a commercial transaction for the purchase of items online from Bicycle Ltd. 
• Bicycle Ltd. via www . bicycle . bg has the right to change the prices of the offered goods at its own discretion, without prior notification. The user is obliged to pay the price that was current at the time of the request of the desired product. The announcement of a price reduction is made by placing the new price below the old one, with the latter crossed out.
• If there is no stock of the requested product, Bicycle Ltd. via www . bicycle . bg , within one working day after receiving the purchase application, notifies the Customer of its exhaustion by sending a message to the e-mail address specified by the Customer or to the specified telephone number. 
• If an incorrect or incorrect address, contact person and/or phone number are specified when submitting the request to Bicycle Ltd. via www . bicycle . bg is not bound by any obligation to fulfill the order. 
• The contract with the Client is considered to be concluded after acceptance by Bicycle OOD via www . bicycle . bg of the purchase application correctly completed by the Customer the order process. 
• Bicycle Ltd. via www . bicycle . bg undertakes, after receiving an application from the Customer, to deliver the desired goods or to inform the Customer about other. circumstances regarding his request. 
• Velosiped OOD is not responsible if the Customer has specified incorrect and/or incomplete data in an order placed at the address "www.velosiped.bg". 
• Velosiped OOD does not guarantee full compliance of the items presented on the site and those available in the store network. 
• Bicycle Ltd. is not responsible for inaccuracies in the information published on the site. Price adjustments in stores are possible, as well as changes in the design of products. • The 
information on sizes and fits published on the site should be interpreted as indicative. Bicycle Ltd. allows the existence of discrepancies between the announced and actual sizes, for which he is not responsible 
• All announced prices are in Bulgarian levs with VAT included. 

II. Rights and obligations of the parties
1. Bicycle OOD undertakes to: 
• confirm the availability of the ordered items or refuse the order within 4 working days; 
• to deliver the goods requested for purchase within the period provided in the information on delivery and payment of goods; In case of seasonal sales, it is possible to extend the delivery time, but not more than 1 working week.
• before being sent, each item is checked for technical condition (if this is possible without disturbing the integrity of the packaging); 
2. The customer undertakes: 
• to indicate his three names, an accurate and valid telephone number, delivery address and e-mail address; 
• to pay the price of the goods according to the conditions described in the information on delivery and payment of goods; 
• to pay the delivery costs according to the conditions described in the information on delivery and payment of goods 
• to ensure access and the possibility of receiving the goods.
The goods requested for purchase are delivered to the delivery address specified by the Customer, within the time period provided in the information on delivery and payment of goods.
The goods are delivered appropriately packed, according to their type and the transport for delivery. 
When handing over the goods, the Customer or a third party signs the accompanying documents. Anyone who is not the holder of the application, but accepts the goods for delivery and is at the address indicated by the customer, is considered a third party. During seasonal sales, it is possible to deliver in parts.
In case of refusal to receive the goods, except in the cases described below, the refusal is considered unfounded and the Customer owes payment of the costs of delivery and return of the goods. In this case, the Customer is obliged to indemnify Bicycle OOD for all damages and lost benefits, including any other costs beyond the costs of delivery and return of the goods, incurred as a result of the refusal.
In the event that the Customer is not found within the deadline for delivery to the specified address or access and conditions for the delivery of the goods are not provided within this period, Bicycle Ltd. is released from its obligation to deliver the goods requested for purchase. The customer can confirm his desire to receive the goods after the expiry of the delivery period in which he was not found at the address, bearing all the costs of delivery. In this case, a new delivery period starts to run accordingly from the moment of confirmation.

The Customer has the right to refuse the receipt of the goods requested for purchase by him, when they are delivered to him under one of the following conditions: • the
delivered goods clearly do not correspond to the goods requested for purchase by the Customer, and this can be established by a simple inspection. 
• the price to be paid by the Customer does not correspond to the price due. 
• in the event of a discrepancy between the requested purchase and the delivered goods, which could not be established at the time of delivery. 
The customer has the right to request an exchange of a size or item appearing in his original order. In this case, it is necessary to declare his desire, in writing (by e-mail) or orally (by phone), within a period of no longer than 30 working days at the address of the city of Vidin, Western Industrial Zone, the company Bicycle Ltd. The customer has the right to return the received items to Vidin Western industrial zone company Bicycle Ltd.
The return is allowed under the following conditions: 
• the request for the return of the goods is submitted in writing to the electronic address for correspondence specified by Bicycle Ltd., within a period of no longer than 30 working days, counted from the date of receipt of the order. The request must contain the client's personal bank account, to which the amount paid by the client for the goods will be refunded. In  case the payment was made with a bank card, the refund is made by ordering a reverse operation on the card with which the payment was made within 5 working days. -  ( the period of 5 working days begins after the receipt of the returned goods ) ; • the goods are in good commercial condition, original packaging, with original labels, accompanied by the original documents issued by Bicycle OOD - invoice, receipt, warranty card (if one was issued); • the customer agrees with a representative of Bicycle OOD the address at which Bicycle OOD wishes to receive the goods back; • the customer pays all the costs related to the transportation of the goods to the address specified by the representative of Bicycle OOD; • in accordance with the provisions of the Civil Code, Bicycle Ltd. refunds the customer the amount paid within 30 days from the date on which the customer exercised his right to return the goods. Bicycle Ltd. reserves the right not to refund the amount paid by the customer, in case of violation of one or more conditions for returning goods. 

Refund of amounts paid by cash on delivery.
When returning amounts paid by cash on delivery, it is necessary to have identity between the person ordering the goods and the person returning the goods, regardless of who received them. It is the person ordering and returning who will receive back the money he paid by cash on delivery. If the orderer is a child, the money is returned to the account of the child or his legal representative - mother, father or guardian. For this purpose, it is necessary to present a Birth Certificate or a Decision on the appointment of a guardian.

III. IDENTIFICATION AND REGISTRATION

• Velosiped Ltd. identifies the Users of the site by storing log files on the www.velosiped.bg server and the IP address of the User.

• Bicycle Ltd. has the right to collect and use information about Users after their registration. The information by which the person can be identified may include name, surname, date of birth, gender, address, telephone, as well as any other information that the person voluntarily provides during registration. The information also includes any other information that the User enters, uses or provides when using the Services provided by Bicycle Ltd.

• Bicycle OOD takes due care and is responsible for protecting the information about the User, which became known to him on the occasion of the registration - subject to these General Terms and Conditions, except in cases of force majeure, accidental event or malicious actions of third parties.

• In the registration form, filled in by the User during registration, Bicycle Ltd. indicates the mandatory or voluntary nature of providing the data and the consequences of refusing to provide them. By expressing agreement with these General Terms and Conditions, the User agrees to have his/her information processed in the order provided for in them.

• The restrictions under para. 1 do not apply in the event that Bicycle OOD is obliged to provide the personal information about the User to the relevant competent state authorities according to the current legislation.

• The user can register by filling in the relevant electronic registration form, available in real time (on-line) on the Internet on the website of Biseli OOD, express agreement with these General Terms and Conditions and declare that he has legal capacity.

• By pressing the virtual "Registration" button, which has the power of written confirmation of the General Terms and Conditions, the User makes an electronic statement within the meaning of the Law on Electronic Documents and Electronic Signatures, by which he declares that he is familiar with these General Terms and Conditions, accepts them and obliges to comply with them. By recording it on a suitable medium in the server of Bicycle OOD, through a generally accepted standard for conversion in a technical way, making possible its reproduction, the electronic statement acquires the quality of an electronic document in the sense of the cited law. Bicycle Ltd. may store in log files on its server the IP address of the User, as well as any other information necessary for his identification and reproduction of his electronic statement of acceptance of the General Terms and Conditions in the event of a legal dispute. The text of the present General Terms and Conditions is available on the Internet on the website of Bicycle Ltd. in a way that allows its storage and reproduction.

• When filling out the registration application, the User is obliged to provide complete and correct data regarding identity (for natural persons), legal status (for legal entities) and other data required by the electronic form of Bicycle Ltd., as well as to update them in 7 ( seven) days from their change. The user declares that he agrees to provide the personal data so requested, thereby guaranteeing that the data he provides in the registration process is true, complete and accurate and, if the latter changes, he will update them promptly. In the case of providing incorrect data, Bicycle Ltd. has the right to terminate or stop immediately and without notice the provision of services, as well as the maintenance of the User's registration.

• Upon registration, the User receives a unique username and password to access the services available through the Bicycle Ltd. website.

• The user name with which the User registers does not give him any other rights, except the right to use the specific user name within the e-store of Bicycle OOD.

• The registrant, in his capacity as a representative of a legal entity, is obliged to enter his full name and address, resp. the name of the legal entity it represents. By accepting the General Terms and Conditions, he guarantees and confirms that he has a contractual relationship with the user registered by him. In the case of entering incorrect or misleading information, the party is deprived of the right to access the services of the Bicycle OOD website.

• The user is obliged to take all care and take the necessary measures that are reasonably necessary in order to protect his password, as well as not to disclose his password to third parties and to immediately notify Bicycle OOD in the event of unauthorized access, as well as in probability and doubt of such. He bears the responsibility and risk for the protection of his password, as well as for all actions that are carried out by him or a third party using his password.

• The user has the right to access in on-line mode to the services provided through the Bicycle Ltd. site, subject to the conditions and access requirements set by Bicycle Ltd. In order to use the services, the User must enter his username and password.

• The user has the right of access and correction in online mode of his personal data provided during registration.

 

IV. Disclosure of information 
• Bicycle Ltd. through " www . bicycle . bg undertakes not to disclose any personal data about the Customer to third parties - government bodies, commercial companies, individuals and others, except in cases where: • it has 
received the express written consent of the Customer; 
• the information is requested by government bodies or officials who, according to the current legislation, are authorized to request and collect such information; 
• Bicycle Ltd. through " www . bicycle . bg " is obliged to provide the information under the law.

V. Liability 
• Bicycle Ltd. via “ www . bicycle . bg "is not responsible for non-fulfillment of its obligations under this contract in the event of circumstances that Bicycle OOD through " www . bicycle . bg ” did not foresee and was not obliged to foresee - including, but not limited to, cases of force majeure, random events, problems in the global Internet network and in the provision of services beyond the control of Bicycle Ltd. through “ www . bicycle . bg

VI. Arbitration
All disputes between the parties shall be resolved in a spirit of understanding and good faith. In the event that no agreement is reached, all unresolved disputes arising out of or relating to the contract between the parties, including disputes arising out of or relating to its interpretation, invalidity, performance or termination, and disputes to fill gaps in the contract or its adaptation to new circumstances, will be permitted by the competent court for registration of Bicycle Ltd. Bulgarian legislation.

VII. Warranty conditions:
1. The company Bicycle OOD issues to its customers, for each purchased bicycle, a warranty card in which the following are mentioned:
• address and phone number of the authorized repair shops of the purchased equipment; 
• the warranty conditions of the relevant service centers or manufacturers; 
• warranty period of the purchased goods; 
2. With the exception of the obligations specifically stated in this guarantee, Bicycle Ltd. cannot be liable for direct, indirect, special, incidental or consequential damages, regardless of whether they are based on contract, in order, as a result of an official's omission or any other legal theory and whether the possibility of such damages is alleged.
3. The warranty conditions of the respective manufacturer or authorized service centers apply to all products offered on this site.

IIX. Warranty Limitations

The warranty is void in the event of:
1. Damage caused by poor transport, storage or incorrect operation.
2. Repair attempt by the Customer and/or other unauthorized person.
3. When using low-quality and non-original consumables.

 

IX. Additional conditions:
1. Bicycle Ltd. is not responsible for damage to the goods due to force majeure.
